How is a cantonal law adopted?

Each canton has its own constitution, assembly and rules. The federal constitutional VNI mechanism applies to cantons generally, not only to the former two special-regime cantons; that regime was deleted by Amendment LXXXV.

  1. Cantonal assembly

The assembly adopts laws within cantonal competence; adoption requires the appropriate assembly majority under that canton’s applicable rules.

  2. Chair, vice-chairs and constituent-people caucuses

Under V.2.7a–7b, more than one chair/vice-chair may identify VNI; if only one does so, two thirds of the corresponding caucus are required. The leadership decides within one week.

  3. Federation Constitutional Court — Vital Interest Panel

Finally decides whether the cantonal act concerns VNI, under V.2.7b and its current reference to IV.A.18.
