How is the Council of Ministers formed?

The Presidency nominates the chair, and the House of Representatives confirms the chair and subsequently the ministers. The House of Peoples does not confirm appointments under Article V.4.

  1. Presidency of BiH

Nominates the chair no later than 15 days after the House of Representatives’ constitutive sitting and immediately submits the decision to the House.

  2. SIPA, CEC and House committee

SIPA checks the prescribed declarations, the CEC checks statutory eligibility, and the committee prepares a confirmation recommendation under the Council of Ministers Law.

  3. House of Representatives of BiH

Confirms the chair, who then takes office; the quorum and entity-voting rules of Article IV apply.

  4. Council of Ministers chair

Within 35 days of confirmation nominates ministers and deputies and seeks House approval; no more than two thirds of ministers may be from FBiH territory.

  5. House of Representatives of BiH

Confirms ministers and deputies, who take office immediately; the outgoing Council remains until the new one is established and operational under law.
