How is a Brčko District law adopted?

The Assembly adopts laws by qualified majority. Additional protection against outvoting applies only to listed matters, and supervision is not a routine presidential veto or an additional reading.

  1. Representative, Mayor or Judicial Commission

A representative may propose a law; the Mayor proposes on behalf of the Government after its approval. The Judicial Commission proposes legislation in the fields under Article 71(2)(f).

  2. Committees and District Assembly

The bill goes to responsible committees; after reports or ten working days without a response, it goes to debate. Ordinarily at least two readings are required; exceptional special procedures are governed by the rules.

  3. Brčko District Assembly

A quorum is more than half of all elected representatives. Adoption and amendment of laws requires three fifths of those present and voting (Articles 32–33), not three fifths of all 31 representatives.

  4. Representatives of constituent peoples

Article 33a requires additional affirmative votes for specifically listed decisions, including certain representative-sponsored proposals and amendments on Article 53(2) matters, holidays and monuments; not automatically for every law.

  5. District Official Gazette

The law is published in the District Official Gazette and takes effect on the eighth day unless it specifies an earlier date for stated reasons (Article 38).

    • Supervisor and Arbitral Tribunal

Under Article 1(6), arbitral awards and Supervisory Orders prevail over conflicting acts, including the Statute. The Order of 31 August 2012 suspended the exercise of supervisory functions while retaining the Supervisor’s authority to resume them at their discretion; this is not an ordinary adoption step.
