Transition 2026
Who sits in parliament while an elected person stays in government?
Explore how suspending a mandate changes the person exercising it — not the number of parliamentary seats.
What if Irfan Halilagić…
A mandate won; executive office continues
Step 1 of 6 · hypothetical sequence
A person from the previous term has an election result for a legislative body. This alone proves neither that they have taken the seat nor that they have requested suspension.
Not yet a roster of active legislators.
Status of the mandate won: Election result; taking up the mandate is not established
One seat. Different roles.

The same suspension, different conditions
This guide follows an executive role carried over from the previous term. That is not the same as newly taking executive office.
- Exception: an executive role carried over from the previous term
A person continuing an executive role from the previous term must suspend the new legislative mandate before the constitutive session. Suspension lasts until a successor is appointed to that same executive role or the person resigns. This category permits at most two suspensions and has no six-month minimum. This explorer models precisely that case.
Election Law, arts. 1.8a(2) and 1.8c(2–3) — OHR, 26 March 2024- General rule for newly taking an executive role
An elected legislator may take an executive role while suspending the legislative mandate. Ordinarily, suspension is allowed at most once during the term and cannot last less than six months. This differs from the exception for continuing an executive role from the previous term.
Election Law, arts. 1.8a(1) and 1.8c(1, 3) — OHR
- A different person, not an extra seat
During suspension, the mandate is allocated to the next candidate on the same list. The original holder’s rights and duties are suspended; the replacement has the full rights and duties of the position. Changing the person does not create an extra seat, and being on the same electoral list does not itself establish the replacement’s current party membership.
Election Law, art. 1.8a(3, 5) — OHR- The fifth day concerns the start of suspension
Suspension takes effect on the fifth day after the written request. The CEC decides suspension and allocation to the next candidate; under its Instructions, the replacement mandate runs from the allocation decision if the candidate has first accepted it. We invent no filing date and do not apply this same deadline to return.
CEC Instructions, arts. 16c(4–5) and 16e(1), p. 9; Election Law, art. 1.8b(2)- Return requires a request and a CEC decision
After the executive role ends, a written request to resume the legislative mandate must be filed within eight days. The CEC decides activation and termination of the replacement mandate within no more than 15 days of the request and informs both people. A request is not a completed return.
CEC Instructions, art. 16d(1–2), p. 9; Election Law, art. 1.8b(1)- Missing the deadline is not automatic loss on day eight
The law ties termination for noncompliance with the suspension rules to a final CEC decision establishing that noncompliance. We show a missed request deadline neither as automatic termination of the mandate nor as a guaranteed return.
Election Law, art. 1.10(1), point 11 — OHR, amendment art. 8- Seven days: the CEC’s official notice for this cycle
On 3 November 2026, the CEC stated that newly elected legislators continuing an executive role from the previous term should submit acceptance, a suspension request and proof of executive office within seven days of publication of confirmed results. The signed acceptance and request must be delivered personally. We have no record of who submitted them.
CEC, Confirmed results of the 2026 General Elections, 3 November 2026 (translated title)- The link between a cantonal mandate and the FBiH House of Peoples
If a person’s cantonal assembly mandate is suspended, the same rule also suspends their FBiH House of Peoples mandate, if they hold one. This does not assert that anyone named here already holds such a delegate mandate.
Election Law, art. 1.8a(4) — OHR- Executive office includes mayors
The statutory definition includes members of the Presidency and Council of Ministers and their deputies, entity presidents and vice-presidents, members of entity, cantonal and Brčko District governments, and city and municipal mayors and their deputies. Local executive office is therefore not automatically excluded when a person is elected to a legislative body.
Election Law, art. 1.1a, point 2 — OHR, amendment art. 1- A council mandate differs from a mayoral role
Klix states that suspension does not cover municipal and city council mandates. We relay this as a media interpretation of the scope of legislative mandates, not as a ban on suspension for a mayor elected to parliament or a cantonal assembly. An express exclusion of councils was not confirmed in the primary text reviewed here.

Why do changes not happen all at once?
Government formation involves several procedures at different speeds across levels. This is an educational overview, not a calendar of confirmed appointments.
Confirmed results: the starting point
The CEC announced its decision confirming the results and the start of statutory deadlines for constituting institutions. This confirms neither individual suspensions nor the composition of new governments.
Source for this stepConstituting legislative bodies
An illustrative, undated step: continuing a previous executive role requires suspension before the elected legislature’s constitutive session. The CEC allocates replacement mandates through its procedure; this is not a report of a session having taken place.
Source for this stepIndirect elections also follow
The CEC announces indirect elections for the BiH House of Peoples, FBiH House of Peoples and RS Council of Peoples. These are connected but distinct procedures, not one completion date for every institution’s transition.
Source for this stepNew executive authorities do not all form at once
An illustrative step, not a forecast: state, entity and cantonal executive authorities have separate procedures. What matters for each person is the end of their own executive role, through a successor’s appointment or resignation, not an assumed common date for all governments.
Source for this stepIndividual return after executive office
An illustrative step: a timely request within eight days leads to the CEC mandate-activation procedure. This view calculates no calendar dates and does not claim that the procedure has been completed for anyone named here.
