How this office is filled

The Assembly elects the mayor. The mayor selects the deputy, chief coordinator and department heads; the Assembly has a time-limited veto, not a mandatory prior confirmation of appointments.

1. Assembly representative

   At the first sitting of the new term nominates a mayoral candidate from among Assembly members.

2. Candidates and Assembly

   Candidates present their programmes. The Assembly elects the mayor by three fifths of all elected members in the first round; a simple majority of all members in the second; failing that, the larger vote in a third-round runoff between the two leading candidates from the second round.

3. Mayor

   Selects the deputy mayor, chief coordinator and no more than 12 department heads on professional criteria, reflecting the composition of the population. Appointment decisions are forwarded to the Assembly.

4. Assembly

   May veto selection or removal of these officials by at least three fifths of all elected representatives within 15 days after the appointment decision is forwarded. The Statute does not require affirmative confirmation of every department head.

5. Government members

   Before taking office take an oath or solemn declaration before the Assembly.

• The Government consists of the mayor, deputy mayor, chief coordinator and department heads.

• Election as mayor ends the representative’s Assembly function and the seat is filled under election laws. The mayor remains in office until a new mayor is elected.

• The deputy and chief coordinator cannot simultaneously be department heads, other administration employees or mayoral advisers. The same person may hold both deputy mayor and chief coordinator functions if the mayor so decides.

• Under Statute Article 1(6), all institutions must comply with the Arbitral Tribunal awards and Supervisory Orders, which prevail over conflicting acts, including the Statute. The Order of 31 August 2012 records suspension of the exercise of supervisory functions while retaining the Supervisor’s authority to resume them at his or her discretion. This is not an ordinary government confirmation step.
